eFiling for Civil

Pursuant to Code of Civil Procedure section 1010.6, California Rules of Court, rules 2.252, 2.253, and 2.259, and Orange County Superior Court Local Rule 352, attorneys generally must electronically file documents in limited, unlimited, and complex civil actions, subject to applicable exceptions and court orders. Self-represented parties are exempt from mandatory electronic filing but may participate voluntarily.

An electronically filed document may generally be submitted until 11:59:59 p.m. on the court day it is due and is deemed timely if received by the Court within that period. Code Civ. Proc., § 1010.6(e)(3). This rule does not extend a filing deadline that otherwise requires filing by a specified time. Cal. Rules of Court, rule 2.252(c). Orange County Superior Court's eFiling procedures provide that documents requiring same-day service should be filed by 5:00 p.m. on the due date.

The electronic filing system generates a confirmation showing the date and time the document was received. Cal. Rules of Court, rule 2.259(a)(1). After the Court determines that the filing complies with applicable requirements and any required fees have been paid, a confirmation of filing is issued under rule 2.259(a)(2). A document received after the applicable deadline or on a noncourt day is generally deemed filed on the next court day.

The following original documents may not be filed electronically:

  • Bench warrants;
  • Subpoenaed documents;
  • Labor Commissioner deposit of cash or check;
  • Bonds; and
  • Undertakings.
