Family Calendar/ Hearing Information
There are many different Judicial Council forms that will allow you to obtain a hearing date. The most common are Order to Show Cause FL300 & Notice of Motion FL301 forms. In order to file hearing forms you must first have an existing case opened with Orange County Superior Court. All hearing forms must be filed at the Family Law filing counter located at 341 The City Drive, Orange, CA 92868, 7th floor clerk’s office rm. C706.
The Order to Show Cause and Notice of Motion forms are the most commonly used and must be accompanied by the Application for Order and Supporting Declaration form FL310. Both of these forms must be filed and served at least 15 days before the hearing. Please refer to the fee schedule for when filing a hearing document.
There may be a first appearance fee if you are the respondent in the case and filing a hearing document, unless the first appearance fee already has been paid.
Request for continuances may require a Declaration and Order, or Stipulation and Order. The counter clerk cannot grant a continuance.
The fees for filing a Notice of Motion or Order to Show Cause to modifying custody or visitation and Ex-parte’s are listed in the fee schedule.
Ex-parte motions are heard by the assigned judicial officer. The moving party must give notice to the assigned courtroom. Those parties that do not have a judicial assignment or courtroom must bring your completed ex-parte paperwork to be processed at the Family Law filing counter at 341 The City Drive, Orange, CA 92868, 7th floor clerk’s office Rm. C706. Ex-parte notice must be given by 10:00 am the day before the ex-parte hearing.
Trial Setting Conference
To obtain a Trial Setting Conference date, you must file an At-Issue Memorandum form L31. There is no fee for this filing. The Court will notify you of your trial date by mail. This hearing will be set for a date no more than 30-45 days from the date the At-Issue Memorandum is filed. Motions regarding trial dates, continuances of trials, and striking At-Issue Memorandums are heard on the trial calendar. You may not reserve dates for these motions.
