Ex Partes - Family Law Ex Partes are heard daily at 8:30 AM. Domestic Violence Ex Partes are heard daily at 1:30 PM.

For assistance with determining the status of a proposed Stipulation and Order, proposed Order and/or proposed Judgment that has been submitted to the Court for signature, contact the courtroom by phone between the hours of 3:00 PM and 4:30 PM.

Every month, the clerk reserves Monday - Thursday for trials. Note: Multiple trials are scheduled to begin on trial-week Monday. On the preceding Friday at 9:30 a.m., the court conducts (off the record) a Trial Readiness Conference (“TRC”) and will triage and stage trials for the following week. Any trial in progress will continue hour-to-hour until completed however…the court will hold attorneys to their time estimates and along the way, an attorney may have to trim evidence to conform to their estimate. Any trial not launched Monday at 8:30 will trail - that is “on-call” throughout Monday - Thursday ….with half-day notice (or NLT 4:30 p.m.) to begin trial. Throughout the trial week, the clerk will provide scheduling reports by email to the attorneys and any self-represented litigant. At noon on Thursday, any trailing case (or case in progress at 4:30 p.m.) will be reset (with priority) to the next trial week. At the TRC, the attorneys must exchange witness lists, trial exhibit lists, trial briefs, expert reports, proposed Order(s), finding(s) and conclusions of law (if any), proposed Xspouse™ or DissoMaster™ summary data page and agree upon a common community balance sheet, if applicable. See court’s separate pre-trial orders. At the TRC, and absent a Stipulation, the court will not consider any walk-in motion to continue trial.

1* L & M rulings are usually posted on-line Thursday, NLT 6 p.m. Note. The court has discretion to decide any motion on the basis of the declarations, memoranda of points and authorities and other documents filed in regard to the pending motion. (See IRMO Lemen (1980) 113 Cal.App.3d 769, 784; Muller v. Muller (1956) 141 Cal.App.2d 722, 731; compare Williams v. Oakland Hosp. (1989) 213 CA3d. 1107, 1111 [No right to oral argument however the judge has discretion to permit it.]) On a case by case basis, the court may announce (via an internet posted ruling) a waiver of oral argument and order the hearing off -calendar, on the basis the decisional process will not be significantly aided by any oral argument. In that instance, the court’s posted web-ruling will be incorporated into a minute order filed and served (by clerk) on the parties.
2* The Trial Readiness Conference is conducted only on the Friday preceding the court’s once-monthly trial week (Monday-Thursday).
3* Order Shortening Time (“OST”): Whenever an ex parte application for an OST is granted, or an Emergency child Custody Investigation is ordered, the specially set or expedited hearing may be scheduled for Friday afternoon so to lessen the impact established calendars and cases.
