Ex Parte Information
- The papers relating to ex parte applications (including the moving papers and any opposition) must be lodged directly in Department CX-102 rather than filed with the clerkâs office. All oppositions must be in writing. No filing fee is imposed until the court orders the papers filed.
- Before the application is heard, counsel are urged to meet and conferred in an attempt to settle the issues presented in the application. The Court may confer informally with counsel to assist in resolving the matter without the necessity of a hearing. If after meeting and conferring the parties are unable to settle the issue, and after presenting the papers in CX 102 and conferring with the Court, then the papers may be formally filed and the matter will be heard based on the papers, normally without oral argument. If the papers are ordered filed, the moving party is required to pay the filing fee, and, when applicable, first paper and complex tax fees.
