Please Note: All Small Claims cases for the Harbor Justice Center - Newport Beach Facility scheduled on or after October 1, 2007 will be heard and processed at the Harbor Justice Center - Laguna Hills Facility.

If you are filing a new Small Claims case, please arrive at the court no later than 30 minutes prior to closing. Please check Court hours below. You may file a Small Claims action if the total amount of damages is $5,000, or less. You may only file two claims that exceed $2,500 in a calendar year in the state of California. A natural person (not a business or public entity) may file for damages up to $7,500, but will still be limited to filing two cases per year above $2,500, but not more than $7,500.

Small Claims night court is available once each month. Night Court is held on the 3rd Tuesday of each month.

This is the proper court to file your lawsuit , if one of the following statements are true:

• A defendant lives in this judicial district, or if the defendant is a business that has its principal place of business in this judicial district.
• A person was injured or personal property was damaged in this judicial district. 
• A defendant signed or entered into a contract in this judicial district, a defendant lived in this judicial district when the contract was entered into, a contract or obligation was to be performed in this judicial district, or if the defendant is a corporation, the contract was breached in this judicial district.
